Virtual Town Hall Listening Session for
Proposed 2026 NCSB FEO 1
Tuesday, June 23 at 5:30 p.m.
Proposed 2026 Formal Ethics Opinion 1 — Closing Attorney's Referral to Law Partner's Title Insurance Agency — is currently before a subcommittee of the NC State Bar Ethics Committee. The opinion addresses four specific inquiries:
- Inquiry 1: May a real estate lawyer own a financial interest in a title company?
- Inquiry 2: May that lawyer recommend and prepare a title opinion for that title company when serving as closing attorney for a client?
- Inquiry 3: May that lawyer's law firm partner refer a client to the same title company and prepare a title opinion in connection with obtaining title insurance through it?
- Inquiry 4: Does the answer to Inquiry 3 change if the referring attorney is an associate rather than a partner?
